These terms and conditions apply to contracts concluded on DJICapture.de between Elektro Zwerg GmbH, Oldenburger Straße 8, 10551 Berlin (the “Seller”), and its customers. DJICapture is the shop and brand name of Elektro Zwerg GmbH and is not a separate company.
The products offered for sale are those listed on the site at the time of viewing. DJICapture reserves the right to modify the catalog at any time. Photographs and descriptions are provided for informational purposes only and do not constitute a contractual commitment.
Prices are shown in euros including VAT, at the rate applicable in Germany. Delivery fees are shown before order confirmation. DJICapture reserves the right to change its prices at any time; products will be invoiced based on the rate in effect at the time of the order.
The Customer places an order online. The order is only final after payment confirmation. If a product becomes unavailable after order confirmation, the Customer will be notified and may choose between an equivalent product or a full refund.
Payment is due immediately upon ordering and is made by instant SEPA transfer. The transfer details are provided after order confirmation. All ordering steps are secured by SSL/TLS protocol. DJICapture reserves the right to cancel an order in case of non-receipt of payment or any irregularity observed.
Delivery times shown in the shop apply unless the product states otherwise. For consumers, the risk of accidental loss or damage passes only when the goods are handed to the customer or a recipient designated by the customer.
Under §§ 312g and 355 of the German Civil Code (BGB), the Customer has 14 days from receipt to exercise the right of withdrawal. The Customer bears direct return costs, except for defective or incorrectly delivered goods. Refunds are handled in accordance with § 357 BGB.
Products are covered by statutory liability for defects under §§ 434 et seq. BGB, with a two-year limitation period from delivery under § 438 BGB. An additional manufacturer warranty applies only when expressly stated in the relevant product description; statutory rights remain unaffected.
Elektro Zwerg GmbH has unlimited liability for intent and gross negligence and for injury to life, body or health. For a slightly negligent breach of an essential contractual obligation, liability is limited to foreseeable damage typical of the contract. Mandatory statutory liability remains unaffected.
The data collected is necessary for processing orders. It is never resold to third parties. In accordance with the GDPR, you may exercise your rights via our Privacy policy.
In the event of a dispute, the Customer shall first contact DJICapture to find an amicable solution. Failing that, the courts of Berlin shall have jurisdiction. German law applies.
